OVERVIEW This website is operated by OstanesKids. Throughout the site, the terms “we,” “us,” and “our” refer to OstanesKids. By accessing or purchasing from this site, you agree to the following terms and conditions (“Terms of Service”), including any additional policies referenced herein or available by hyperlink.

These Terms apply to all users, including visitors, browsers, and customers. Please read these Terms carefully. If you disagree with any part of these Terms, you may not access the website or use our services.

1. ONLINE STORE TERMS

By agreeing to these Terms, you confirm that you are of legal age in your jurisdiction or have obtained consent from your legal guardian. You agree not to use our products for any illegal or unauthorized purposes. A breach or violation of any of the Terms will result in an immediate termination of your Services.

2. CUSTOM ARTWORK & INTELLECTUAL PROPERTY

Since our service involves bringing your drawings to life, the following rules apply:

Your Rights: You retain all ownership rights to the original characters and drawings you upload.
Our License: By uploading artwork, you grant OstanesKids a non-exclusive, worldwide license to use, reproduce, and 3D model that artwork solely for the purpose of fulfilling your order.
Marketing: We love showing off our forge! We may photograph or video your finished figurine for social media or marketing. If you wish for your order to remain private, please notify us at wizard@ostaneskids.com at the time of purchase.
Third-Party IP: You warrant that you own the rights to the artwork you upload. OstanesKids is not liable for any trademark or copyright infringement resulting from the 3D modeling of user-submitted content.

3. RIGHT OF REFUSAL

We reserve the right to refuse any order. Specifically, we will not produce figurines that contain:

Hate speech or symbols of hate.
Explicitly illegal or highly offensive content.
Content that infringes on clearly established third-party copyrights (e.g., direct copies of big-brand movie characters) without a "transformative" artistic element.
If we refuse an order for these reasons, a full refund will be issued immediately.

4. ACCURACY OF CUSTOM SPECIFICATIONS

Our figurines are handcrafted interpretations of 2D drawings.

Interpretations: You acknowledge that 3D modeling requires artistic interpretation. While we aim for 100% accuracy, slight variations in color, proportions, and "3D translation" are part of the artistic process.
Approvals: Once you approve a 3D sculpt via our digital preview, you accept the geometry of the model. Subsequent changes to the core structure after approval may incur additional fees.

5. PRICING & MODIFICATIONS

Prices for our products are subject to change without notice. We reserve the right to modify or discontinue the Service (or any part thereof) without notice at any time.

6. ACCURACY OF BILLING & ACCOUNT INFORMATION

You agree to provide current, complete, and accurate purchase and account information. We reserve the right to refuse or cancel orders if we suspect inaccurate or fraudulent information is provided.

7. PERSONAL INFORMATION

Your submission of personal information through the store is governed by our Privacy Policy.

8. PROHIBITED USES

In addition to other prohibitions set forth in the Terms of Service, you are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (d) to upload or transmit viruses or any other type of malicious code.

9. DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

OstanesKids figurines are decorative keepsakes and are not intended as toys for children. We are not liable for any injury, loss, or damage resulting from the misuse of the product, including but not limited to choking hazards or breakage during play. All products are provided “as is” for decorative purposes.

10. GOVERNING LAW

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the United Kingdom.
